David Grebel recently settled a case where a man rear ended a tractor trailer which was lawfully parked on the side of the highway for an undisclosed sum. This amount was required to remain confidential pursuant to an agreement between the parties. In the case, the individual was driving his motor vehicle on the highway when, for reasons unknown, he swerved onto the shoulder and struck the rear end of a tractor trailer.
David Grebel was able to argue that this tractor trailer should not have been on the side of the road, as it had a pattern of breakdowns and mechanical problems before the date of the incident. On the date of the incident, this tractor trailer had the “check engine” light on before the vehicle broke down onto the side of the road. David Grebel successfully argued that this was negligence on the part of the truck driver and the trucking company. The trucking company fought extremely hard for many years against David Grebel, before agreeing to the settlement.
